In order to enable the use of the web sales service through mojtoner.mk and apollo.mk, which is described in detail in the section entitled: "How to buy" and "Delivery information", it is necessary for APOLO DOOEL to collect and process certain of your personal information. Specifically, we need your name and surname, residential address, e-mail address and telephone number. You provide this information at the time of your registration on our website and further at the time of ordering the product. At that time, you agree to provide your personal data, so that they are processed by APOLO DOOEL for the stated purpose.

All information related to or arising from a purchase made by our customer on our web store is considered a business secret and is treated as such in accordance with the laws of the Republic of N. Macedonia.

2. What personal data do we collect and how to collect personal data
For system protection, every time you visit our websites, our web server temporarily registers your domain and IP address of the workstation, along with some other technical data related to the session or visit to the websites.

Also, in certain cases, we write information in the form of "Cookies" on your computer, to adjust the visit to the websites according to your needs and habits. "Cookies" are small files that are entered on the visitor's computer by the web server. All information stored within the "Cookies" can be used only for the needs of the web service in a way that your privacy will not be compromised.

We process your personal data only if you voluntarily provide it by registering on our site for the use of our products and services in accordance with the regulations for personal data protection of the Republic of North Macedonia. The data during your registration on the website and when using the on-line shopping service are collected directly from you, i.e. in a way that you personally and directly submit the data to us or automatically through the tool "Cookies" if you have agreed to it (You please read the Cookie Notice).

During your registration on the website and creation of your profile, APOLO DOOEL collects and processes your personal data as follows: Your name and surname, address, telephone number and e-mail address. When using the On-line purchase service, APOLO DOOEL collects and processes your personal data as follows: Your name and surname, address, telephone number and e-mail address. When using the Reclamation and product return service, APOLO DOOEL collects and processes your personal data as follows: Your name and surname, telephone number, e-mail address and transaction account.

When using the Contact in Information service, APOLO DOOEL collects and processes your personal data, as follows: Your name and surname, e-mail address and telephone number. Additionally, our website uses the "Cookies" tool to collect data such as: browser name, computer type, as well as technical information about the connection you use when visiting the website, such as operating system and the Internet Service Provider, IP (Internet Protocol) addresses that are assigned by the Internet Service Provider and are different for each user. The collection and processing of this data is done with your consent and acceptance of our tool for "Cookies". For more details, please read the Cookie Notice.

3. For what purposes is your data collected and processed?
APOLO DOOEL collects and processes your personal data exclusively for the purposes for which they are given such as:
- enabling on-line use of our services and products;
- administering the content, promotions, surveys and other functionalities of the site, in order to improve its quality and the services we offer through it;
- timely informing the users about their products, as well as about all actions and promotions of their products (direct marketing), please see for more details in part 5; - for realization of on-line orders available on the websites mojtoner.mk apollo.mk (timely and accurate delivery, collection of the price for the sold items)
- for product complaint;
- for contact by e-mail.

4. Manner of processing your personal data and deadlines for storing your data
Your personal data will not be processed for any purpose other than the purpose for which it was collected. The collected personal data are processed mechanically and / or electronically, exclusively by persons / employees hired by the Controller who have access to them and who are authorized to perform analyzes, as well as by respecting the principles of personal data processing by Law of Personal Data Protection.

The processing of your personal data APOLO DOOEL performs in accordance with the regulations for personal data protection of the Republic of North Macedonia, taking all prescribed technical and organizational measures to ensure confidentiality and protection in the processing of personal data at its disposal.

Additionally, APOLO DOOEL applies security measures when collecting, storing, and processing information to protect against unauthorized access, alteration, disclosure or abusement of your personal data, as well as non-personal data, which are stored on our site. Personal data can be submitted only to the competent authorities, in accordance with the legally prescribed procedure.

If you decide to withdraw your consent to the processing of your personal data, your personal data will be deleted, except for the personal data for which APOLO DOOEL has a legal obligation to keep them within a legally determined period in accordance with the Law of Archive Material or other applicable law. APOLO DOOEL processes the personal data during your registration on the website and creation of your profile until the withdrawal of the consent, ie until the moment when you decide to delete your profile or you ask us to do it for you. For the personal data when using the On-line purchase service, APOLO DOOEL has a legal obligation to keep all documents and records with your personal data, which refer to realized sales and payments, within 3 (three) years or longer legal deadline (if prescribed by law) which is mandatory for keeping accounting documentation and documents related to payment operations in accordance with the Law of Archival Operations.

The personal data when using the web-shop service of APOLO DOOEL is kept until the withdrawal of your consent, unless they are given for the realization of your rights regarding the purchased product, in which case APOLO DOOEL keeps the data for 3 (three) years or a longer legal deadline (if prescribed by law) which is mandatory for keeping accounting documentation and documents related to payment operations in accordance with the Law of Archival Operations.

5. Policy for the manner of processing personal data for the purposes of direct marketing
We may use your personal information to send you direct marketing announcements about our products and services or our related services, including our announcements of the latest products and upcoming events. It can be in the form of email, posting, SMS, telephone, or targeted internet ads. 6. Your rights as a subject of personal data
In accordance with the Law of Personal Data Protection, as an entity whose personal data we process, you have the following rights:
- to be informed by APOLO DOOEL about the manner of processing the personal data, including whether the personal data are used in accordance with the purpose for which they are given;
- to ask APOLO DOOEL to add, change and / or update if your personal data is incomplete, inaccurate, or out of date upon submission of a request, whereby APOLO DOOEL should act upon the same within 15 days and make correction of the personal data;
- to ask APOLO DOOEL to limit the processing of personal data with appropriate indication which personal data will be stored;
- to ask APOLO DOOEL to delete your personal data, whereby APOLO DOOEL is obliged to delete the personal data within 30 days from the day of submitting the request for deletion, under conditions provided in the Law of Personal Data Protection;
- to submit a request to APOLO DOOEL, with which you will withdraw the consent given for the purposes of personal data processing;
- to submit a complaint to APOLO DOOEL in the manner of processing your personal data; - to log out / cancel the processing and use of your personal data in APOLO DOOEL for the purposes of direct marketing.

APOLO DOOEL does not transfer personal data to third countries.

9. Changing the Privacy Policy and Terms of Use
APOLO DOOEL reserves the right to change the Privacy Policy and Terms of Use at any time and without prior notice. Therefore, in order to be up to date with any changes made, given that they are binding on you and us, we invite you to periodically check whether such changes have occurred.

The terms of use are interpreted exclusively in accordance with the laws of the Republic of N. Macedonia.

The Privacy Policy can be changed at any time by posting the amended text of the Privacy Policy on our website, as well as the date of the update. Changes to the Privacy Policy take effect immediately upon publication. Therefore, please periodically review and read the Privacy Policy. By continuing to access and use our website, the user agrees to the changes and accepts the provisions of this Privacy Policy.

10. Guarantees and responsibilities
APOLO DOOEL with Unique Tax Number 4030999366091 manages the pages mojtoner.mk and apollo.mk from its headquarters on st. Nikola Parapunov no. 27/3-5 1000 Skopje. In this way, APOLO DOOEL guarantees that the content of these websites, as well as the conditions for their use, are in accordance with the legislation of the Republic of N. Macedonia. On the other hand, APOLO DOOEL does not guarantee that the content and use of the services is in accordance with the laws of other countries from which the consumer could access this website.

If you visit these websites or use our services outside the territory of the Republic of N. Macedonia, you are aware of the consequences, you are responsible for any possible violation of the applicable laws of the country from which you access the websites or use of their services.

Additionally, APOLO DOOEL is not responsible for and completely distances itself from the content it has on the websites that can be reached through the links displayed on our site. These links lead to the websites of independent legal entities. If you use these links, you leave our website. APOLO DOOEL does not control the content and security of these pages, nor when posting the links, nor does it monitor whether any changes occur on them. As a result, APOLO DOOEL is not responsible or obliged to provide statements and information about the content of those websites, their software, products, and materials found there, or any consequences of their use. If you decide to use any of the links on our site that lead to other sites, you do so at your own risk.

APOLO DOOEL has no obligation to control or review the content of the statements of the users as well as their mutual communication that takes place on this website. However, APOLO DOOEL has the right to remove the content published by the users, if it considers that it consists of insults, slander, threats or other things that are not acceptable. APOLO DOOEL is not responsible for the violations that will be committed by third parties on the website, regardless of whether that violation violates the rights of persons guaranteed by the applicable laws of the Republic of N. Macedonia.

APOLO DOOEL Skopje does not guarantee that the ordered product is in stock. Orders are processed every working day from 08:00 to 16:00. If at the moment of processing the order the ordered product is not in stock, APOLO DOOEL is obliged to inform you within 7 (seven) working days about its unavailability.

11. Delivery
The courier service picks up the shipments from the warehouse of APOLO DOOEL every working day from Monday to Friday from 8-15 h, with the usual delivery time at your address of 24h. on the territory of the city of Skopje, while for addresses in the interior, the usual deadline is 48h. If the pick-up is on a Friday or before a holiday, delivery usually takes one or two business days. For the delivery to be successful you need to be present at the address indicated for delivery.

Only if there is a problem with the availability of the products, or about products on request, our operator will contact you within one to two working days. If the order is made on Friday after 12 o'clock, weekend or during holidays, the operator will contact you at the beginning of the next working week.

12. Right to reclamation
When the ordered product is delivered to you, you are obliged to immediately review it to determine if the product corresponds to your order.

If the delivered product does not correspond to the ordered product in terms of description, code, quantity or for other reasons deviates from the ordered product, then you have the right to request a replacement for the delivered product within 5 days from the day of sale.

In case an unsuitable product is delivered, please inform us at sales@mojtoner.mk or sales@apollo.com.mk or on 02/3092-995 within 24 from the moment of delivery. We will inform you as soon as possible about the further steps that need to be taken in order to exercise your rights as a consumer.

If APOLO DOOEL does not have the same product with which to replace the delivered unsuitable product, then you have the right to demand a refund for the same or to wait for the product to be replaced with a suitable one when there is one. APOLO DOOEL undertakes to inform you if there is such a product for sale within a period that can not be longer than 30 days from the date of receipt of the request.

In the event of a refund, they will be refunded to the transaction account specified in the Replacement Request, or to the manner in which the original payment was made.

13. Delivery of defective product
When the ordered product is delivered to you, you are obliged to inspect it immediately to determine if there are certain defects of the delivered product.

The product has defects when it does not fulfill the general safety obligation set out below, ie it does not provide the kind of security that the person rightly expects to have, based on all the circumstances, as follows:
- based on the presentation of the product;
- the use for which it is reasonable that the product will be used;
- the time when the product was placed on the market;
- when it does not fulfill the general obligation for compliance determined in the Law on Consumer Protection or the contractual obligations.

A safe product is any product which under normal or reasonably foreseeable conditions of use, including the period of use, does not present any risk or the risk is minimal and commensurate with the benefits of using the product and which meets the conditions under which it is provided. A high degree of protection of the safety and health of people, taking into account:
- the properties of the product, including its composition, packaging, instructions for assembly, use, and maintenance;
- the effect on other products where it is logical that it will be used together with other products;
- the presentation of the product, its markings, labeling, instructions for use, disposal, and any other markings or information given on the product;
- categories of consumers, especially children and the elderly who are at risk when using the product.

The consumer to whom a defective product has been sold has the right to request:
- free removal of product defects or reimbursement of costs incurred to eliminate the defect;
- proportional reduction of the selling price;
- replacement of the product with an appropriate product with the same trademark, type, industrial design or designation of origin and geographical indication of the product;
- replacement of the product with an appropriate product with another trademark, type, industrial design or designation of origin and geographical indication of the product with appropriate reduction or increase in production price;
- termination of the contract, refund of the paid amount and compensation for the suffered damage.

The consumer has no right to terminate the contract if the damage of the product is minimal.

In order to exercise the rights listed above, the consumer is obliged to submit an appropriate letter. APOLO DOOEL is obliged to receive the product with defect from the consumer and to satisfy his requests, unless he proves that the defects of the product occurred due to violation of the rules of use and storage by the consumer, third parties or force majeure. The consumer has the right to attend the quality check of the product.

In the event of a refund, the consumer will be refunded to the transaction account specified in the relevant Request, or to the manner in which the original payment was made.

14. Policies for using the e-commerce system.
By accessing the websites of mojtoner.mk and apollo.mk and when ordering products / services, you agree that you accept the terms of this Policy for using the e-commerce system.

15. Policy for protection of personal data of cardholders
APOLO DOOEL will use the personal data in accordance with the Law on Personal Data Protection and other appropriate regulations of the Republic of S. Macedonia. It will not disclose personal data to any third party, except in cases where it is permitted or legally prescribed, to exercise its rights or to protect its interests or to comply with court orders or other legal or regulatory needs. The buyer guarantees the accuracy of the data entered. APOLO DOOEL does not bear any responsibility if the entered data are not correct.

APOLO DOOEL takes all necessary measures for protection of personal data, in order to prevent loss, theft and abuse, as well as unauthorized access, alteration, or destruction. APOLO DOOEL has no insight into the number, date, validity, and security code of your payment card for the entire duration of the transaction, nor does it have access to any information related to your bank account. The data is entered on the web portal of the processing center that processes online payment transactions. When paying by card online, the entry of the card data is done on the protected page of the bank, NLB Banka AD Skopje, whereby APOLO DOOEL does not have access to the data on your payment card at any moment. When entering payment card data, confidential information is transmitted over the public network in a protected (encrypted) form using the SSL protocol and PKI system, currently as the most modern technology. The security of the data at the time of purchase is guaranteed by the processor of the payment cards, whereby the complete payment process is performed on the page of the payment system.

16. Policy and conditions for delivery of product and service
This Policy applies to the delivery of products ordered electronically, whereby the products will be delivered via the selected courier mail to the address specified in the order.

The products and their prices will be displayed on the pages mojtoner.mk and www.apollo.mk. APOLO DOOEL strives to provide appropriate photos, prices, and stock of products, but cannot guarantee that they are always without error. The accuracy of this information can be obtained by calling 02/3095 958. Payment for the products can be by credit / debit card, by non-cash payment of invoice, or in cash upon receipt by the courier service.

Postage is included in the final price of the product when ordering.

17. Refund policy after payment card transaction
APOLO DOOEL will refund the buyer's funds, if a wrong payment is made, and the right can be exercised by submitting a written request and proof of payment, which will indicate the date when the wrong payment was made and in what amount.
